General terms and conditions for the purchase of goods from CLUB OF QUALITY GmbH

1. SCOPE OF THE GENERAL TERMS AND CONDITIONS

All deliveries and services provided by CLUB OF QUALITY GmbH

in connection with the sale and delivery of goods from the online shop are carried out exclusively on the basis of these General Terms and Conditions (GTC).

2. ORDER

2.1. The buyer's contractual partner is CLUB OF QUALITY GmbH, Ben Gurion Ring, 60437 Frankfurt am Main.

2.2. When placing an order in the online shop, the offer to conclude a contract is made by the buyer as soon as he or she initiates the order for goods. After receipt of the order, the customer receives a confirmation of receipt by email. The confirmation of receipt of the order by email does not constitute a declaration of acceptance. The purchase contract is only concluded when CLUB OF QUALITY GmbH declares acceptance. This occurs at the earlier of the two dates, either sending the goods or sending a shipping confirmation by email.

2.3. The ordered goods will be delivered within the specified delivery time, subject to their availability. The delivery period begins with receipt of payment. If payment against invoice or cash on delivery has been agreed, the delivery period begins with the declaration of acceptance by CLUB OF QUALITY GmbH. If the goods are not available, the buyer will be informed immediately and will receive a refund for any consideration provided immediately.

If the delivery period - or a grace period set due to force majeure or other reasons for which CLUB OF QUALITY GmbH is not responsible (e.g. postponements by suppliers despite CLUB OF QUALITY GmbH maintaining sufficient stocks) - is unreasonable for the customer, he can withdraw from the contract immediately after becoming aware of it by means of a declaration in text form (fax, letter or email). Other statutory rights of the customer remain unaffected.

2.4. The product descriptions, in particular images, drawings, descriptions, dimensions and weight data are non-binding insofar as the delivered goods deviate only insignificantly from these details (e.g. due to production). Color deviations of the goods shown on the website are due to technical reasons.

3. PAYMENT TERMS, DELIVERY, SHIPPING COSTS

3.1. The prices stated include statutory sales tax plus shipping costs. The total price of the goods including shipping costs is listed in the shopping cart before placing the order.

3.2. Delivery is made to Germany and other countries, according to the table provided in the shop. If several items are ordered, the longest delivery time applies.

3.3. In addition to the value of the goods, shipping and packaging costs may be incurred. This does not initially include the cost of returning the goods by the customer in the event of a cancellation in accordance with the cancellation policy below. The customer may bear the cost of the return.

3.4. CLUB OF QUALITY GmbH is entitled to partial performance and early deliveries within the scope of what is reasonable for the customer.

3.5. Payment is made through online payment systems, such as "PayPal". Unless otherwise agreed, the purchase price is to be paid immediately upon receipt of the invoice or the goods.

3.6. The goods remain the property of CLUB OF QUALITY GmbH until full payment has been made. If the buyer defaults on payment, he must also pay a flat-rate reminder and processing fee of € 15.00, without prejudice to further claims by CLUB OF QUALITY GmbH (e.g. interest, chargeback fees). The buyer is permitted to prove that the expenditure was not incurred or not incurred to this amount. If the goods are not accepted in the case of cash on delivery or advance payment or if payment is not made within 7 days of receipt of the invoice or goods, CLUB OF QUALITY GmbH will exercise its right of withdrawal and the order will be cancelled. Further claims due to Non-fulfillment or similar remain unaffected.

4. RIGHT OF WITHDRAWAL

4.1. Consumers have a two-week right of withdrawal.

4.2. The right of withdrawal does not apply to distance selling contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer and sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

5. CANCELLATION POLICY

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
